ARTICLE 29:  YEAR-ROUND/CONTINUOUS SCHOOLS

Provisions of this article apply to year-round/continuous schools only, if and when these schedules are implemented.  Except for these provisions, members of the unit involved in year-round/continuous schools will be subject to all other provisions of the agreement.
29.1Evaluation
29.1.1Every probationary certificated employee shall be evaluated by the administrator, in writing, at least once each school year, no later than thirty (30) calendar days prior to the last school day scheduled on the assigned school calendar track for the school year in which the evaluation takes place.  Every permanent employee shall be evaluated by the administrator, in writing, no less than every other year, no later than thirty (30) calendar days prior to the last school day scheduled on the assigned school calendar track for the school year in which the evaluation takes place.  Furthermore, the employee evaluated shall receive a written copy of the evaluation no later than thirty (30) days prior to the last school day scheduled on the assigned school calendar track for the school year in which the evaluation takes place.
29.2Substitute Assignment
29.2.1Unit members may be employed by the District as substitute teachers.  If the unit member agrees to substitute, he/she shall be paid $100 per day.
29.3Intersession
29.3.1During the intersession, unit members may be employed by the District to provide regular instruction which the District credits toward the state minimum of 180 school days.  If the unit member agrees to the extra assignment, he/she shall be paid at their per diem rate.  These unit members shall accrue one (1) day sick leave per eighteen (18) intersession work days.
29.3.2Unit members at the site shall have first priority for intersession positions.
  29.3.3  During the intersession, unit members may be employed by the District to provide instruction in excess of the required state minimum instructional year; e.g., Summer School.  If the unit member agrees to the extra assignments, he/she shall be paid the "Summer School" rate of pay as set forth in Appendix A-5, Cocurricular and Miscellaneous Pay Schedules, Certificated Personnel.
29.4Transfer Provisions Applying to an Existing Site Which is Designated to Convert to a Year-Round/Continuous School
29.4.1Unit members working at the site designated to convert to a year-round/continuous school shall have the right to remain at that site and shall receive their track assignment on or before February 10.
29.4.2For the planning year only, unit members at the designated site who request a transfer in writing from that site by February 17 of the year prior to the conversion date shall be transferred from a year-round/continuous school program to vacancies open in the regular school program for which they are qualified at the discretion of the administration.  The above mentioned date may be changed to a later date at the discretion of the District administration.
29.4.3In subsequent years, any unit member who requests a transfer to another site shall do so in accordance with Article 10 and the transfer shall be governed by Article 10 of the Agreement,  Transfer, Assignment and Reassignment.
29.4.4Unit members volunteering for vacancies in year-round/continuous schools shall submit their requests in writing no later than December 1 of the year prior to the year of implementation.  This deadline date may be delayed at the discretion of the District administration.  Requests shall receive consideration for vacant positions.  Final selection for these vacant positions shall be based upon individual training, experience and credential, legal requirements of the district, skills in areas which are secondary to the assignment, educational needs of the school or department to which the unit member is transferred, special strengths and interest of the teacher.  If the district determines that the above considerations are equal as applied to two or more applicants, then seniority shall be the controlling factor.
29.5Transfer Provisions Applying to a New Site Which Opens as a Year-Round/Continuous School
29.5.1Unit members volunteering for vacancies in year-round/continuous school shall submit their requests in writing no later than December 1 of the year prior to the year of implementation.  This deadline date may be delayed to a later date at the discretion of the District administration.  Requests shall receive consideration for vacant positions. 
Final selection for filling vacant positions shall be made by the administration based upon individual training, experience and credential, legal requirements of the district, skills in areas which are secondary to the assignment, educational needs of the school or department to which the unit member is transferred, special strengths and interest of the teacher.  If the district determines that the above considerations are equal as applied to two or more applicants, then seniority shall be the controlling factor.
29.5.2Involuntary transfers shall be governed by Article 10,  Transfer, Assignment and Reassignment.
29.6Reassignment
29.6.1For purposes of this article only, reassignment is defined as involving a change in assignment from one track to another track on the same site.  Reassignment from one grade level to another not involving a change in track shall be governed by Article 10, Transfer, Assignment and Reassignment.
29.6.2In making initial assignments to tracks, principals shall work collaboratively with members of the unit.  "Collaboratively" is defined as obtaining input from unit members concerning their respective preferences.  Final assignment of unit members to the respective tracks shall be made by the administration based on individual training, experience and credential, legal requirements of the district, skills in areas which are secondary to the assignment, educational needs of the school or department to which the unit member is transferred, special strengths and interest of the teacher.  If the district determines that the above considerations are equal as applied to two or more applicants, then seniority shall be the controlling factor.
29.6.2.1  The calendar of specialists working at year-round, multi-track schools shall be agreed upon by the unit member and superintendent's designee.
29.6.3Unit members requesting a change in track assignment shall submit the request in writing to the site principal no later than March 1 of the year preceding the effective date of the proposed change.  Approval or disapproval of the request for change is at the discretion of the administration.
29.6.4  Unit members transferring in or out of the year-round/ continuous school program shall be provided with reasonable assistance from the District with the moving of instructional materials.
29.6.5  Unit members at a year-round/continuous school site shall be provided reasonable assistance from the District with the moving of instructional materials at the end of or beginning of a track in the year-round/continuous school program.
29.6.6  Unit members being transferred or reassigned to an alternate room location, track, or site throughout the school year shall be provided with a maximum of one (1) release day in these instances.  The District shall provide reasonable assistance in moving instructional materials.
29.6.7Unit members being transferred or reassigned to another grade level shall be provided with a maximum of three (3) release days.  The District shall provide reasonable assistance in moving instructional materials.
29.7Extended Work Year
29.7.1In meeting the instructional needs of students, the work years of certain specialist positions (such as, but not limited to, elementary enrichment programs, psychologist, resource specialist) may be extended beyond the base year of 186 days for new regular teachers and 185 for returning regular teachers, as contained in Article 6, Hours.  If there are such extensions the positions affected shall be at the discretion of the District.  This extension of work year shall be assigned on a year-to-year basis, renewable at the discretion of the District.
29.7.1.1  The calendar of extended year work days shall be agreed upon by the unit member and superintendent's designee.
29.7.2The criteria for selecting members of the unit occupying such selected positions outlined in Article 31.7.1 who will work the extended year shall be as follows:
29.7.2.1  Incumbents in the position to be extended shall have te right of first refusal.
29.7.2.2  Extended work year positions shall be filled on a voluntary basis.
29.7.2.3  Unit members working an extended work year shall be compensated at their per diem rate.
29.7.2.4  Unit members working an extended work year shall accrue additional sick days on a pro-rata basis with one day of sick leave being granted per 18 duty days beyond the regular teacher work year.
29.8  Salary Advancement
Application for advancement for unit members in the year-round/continuous school programs shall be submitted to the personnel office on or before May 1 to be effective for the pay period beginning July 1 and on or before December 1 to be effective for the pay period beginning January 1.  Verification of completion of all required credits must be accomplished prior to 10th day of September for the pay period beginning July 1 and the 10th day of February for the pay period beginning January 1.
29.9  Salary Time Table
Unit members working in a year-round/continuous school program may elect to be compensated on a 12-month basis with the first check being issued on August 1 or on a 10-month basis with the first check being issued on October 1.
29.10  Family Members
Unit members who are married and are assigned to a year-round/continuous school program will be given consideration in being assigned to the same track.
29.10.1  Unit members who are assigned to a year-round/continuous school program and have children attending year-round/continuous school programs, those children will be given consideration in being assigned to the same track as the unit member.
29.11  Notice to Off-Track Unit Members
The District will make a reasonable effort to notify off-track unit members of job vacancies, changes in District policies that are pertinent, and changes at their work site.
29.12Discontinuance or Modification of Year-Round/Continuous School Program
29.12.1The year-round/continuous school program may be modified or discontinued at the discretion of the Board of Education.  The Superintendent shall notify the Association within a reasonable amount of time prior to action being taken on such modifications or discontinuance.
